Terms of Service

1. Who we are

These Terms of Service (“Terms”) govern your use of the Cyber Portal web application and related services (collectively, the “Service”) operated by LETO PTY LTD (“we,” “us,” or “our”).

2. Who may use the Service

The Service is intended for use by organisations and their authorised users. You may use the Service only if you can form a binding contract with us and only in compliance with these Terms and applicable law. If you access the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Accounts and access

  • Access may be provided by an administrator for your organisation. You are responsible for safeguarding your credentials and for activity under your account.
  • You must provide accurate information and keep it up to date where required.
  • We may suspend or terminate access to protect the Service or other users, or where we reasonably believe these Terms have been violated.

4. Acceptable use

You agree not to:

  • use the Service in violation of any law or third-party rights;
  • attempt to gain unauthorised access to the Service, other accounts, or related systems;
  • probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures;
  • use the Service to send malware, conduct phishing, or deceive end users, except where such activity is an explicit, authorised feature of the Service for your organisation (for example, authorised security awareness simulations) and is used in accordance with your organisation’s instructions and applicable law;
  • reverse engineer, decompile, or disassemble any part of the Service except to the extent permitted by law;
  • use the Service to build a competing product or service, or to harvest data without authorisation;
  • harass, abuse, or harm another person, or use the Service in a way that we reasonably consider objectionable or harmful to the Service or others.

5. Training, simulations, and content

The Service may include training materials, assessments, and—where your organisation has enabled them—simulated or educational exercises designed to improve security awareness. You acknowledge that your organisation is responsible for how such features are configured and for ensuring that use complies with employment law, policy, and any notice or consent requirements that apply in your context.

6. Intellectual property

The Service, including its software, branding, and content we provide, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during the term of your (or your organisation’s) agreement with us, subject to these Terms. You may not copy, modify, or create derivative works except as allowed by the Service’s intended functionality or by law.

7. Third-party services

The Service may link to or integrate with third-party services (for example, analytics, support widgets, or document tools). Your use of those services is subject to the third party’s terms and privacy policy. We are not responsible for third-party services we do not control.

8. Disclaimers

The Service is provided “as is” and “as available” to the maximum extent permitted by law. We disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed by law.

9. Limitation of liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law where it applies) and any other applicable law: our total liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees you (or your organisation) paid in the 12 months before the event giving rise to the claim, and (b) AUD 1,000, and we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, except where such a limitation is not permitted by law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded, restricted, or modified under law.

10. Indemnity

To the extent permitted by law, you will indemnify and hold harmless LETO PTY LTD and its directors, officers, and employees from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms or applicable law, except to the extent caused by our gross negligence or wilful misconduct.

11. Changes

We may update these Terms from time to time. We will post the updated version and revise the “Last updated” date. If changes are material, we will use reasonable means to notify you (for example, by email or in-product notice). Your continued use of the Service after the effective date of changes constitutes acceptance, where permitted by law.

12. Governing law and venue

These Terms are governed by the laws of the State of Victoria, Australia, and the courts of the courts of Victoria, Australia have non-exclusive jurisdiction, subject to any mandatory rights you have as a consumer under the law where you live.
